Terms and Conditions

Last updated: 2026-10-28

These Terms and Conditions ("Terms") govern access to and use of the website at www.SelltheStuff.com and related services (the "Site"). Sell the Stuff is a business name registered in British Columbia by The Man Fork Inc., 104-1070 Nelson Street, Vancouver, BC V6E 1H8. When these Terms refer to "Sell the Stuff", "we" or "us", they mean The Man Fork Inc. By creating an account or using the Site, you agree to these Terms and to the Privacy Policy.

If you do not agree, do not register and do not use the Site.

1. The marketplace

Sell the Stuff is a venue that helps people find each other. It is not a retailer, auctioneer, warehouse, insurer, escrow agent, or party to a sale of goods. Move the Stuff only transports an item and does not make us a party to the sale.

Three roles show up in the product:

  • Owner — a registered user who lists goods they want sold.
  • Seller — a registered user who may store, handle, list, and sell an Owner's goods on the Owner's behalf, then pay the Owner according to the agreement those users form on the Site.
  • Buyer — a person who purchases goods from a Seller. A Buyer is not a login on this Site. Buyers deal with the Seller (and, where relevant, the Owner), not with the operators.

Users choose their own counterparties, prices, handoff, storage, and sale terms. We do not take possession of goods, supervise storage or handling, guarantee a sale, or control what users say or do.

Move the Stuff carries an item from a pickup address to a drop-off address when a buyer and the person selling that item (for example on Facebook Marketplace, Kijiji, or Craigslist) do not have a vehicle. Either of those people may book and pay for the transport. They decide between themselves who pays us. We only transport the item. We are not a party to that sale. We do not collect, hold, or pay the item's price.

The person who books pastes the listing link and confirms the item is already paid. We email the other person a link to confirm the item is paid. The mover is dispatched only after both confirm. The saved card is charged when the drop-off is finished, not when the job is booked. The price is labour by time, driving between the two addresses, and a platform cut. Flexible timing takes its discount from the platform cut. A faster job is charged for the actual on-site time. If the access answers were wrong, the mover posts a photo and the difference can be charged. That charge can be contested through the dispute process on the Site. The mover records arrival and completion at the pickup and at the drop-off, including a location check and a condition photo at each end.

2. Accounts

You must provide accurate registration information and keep your password confidential. You are responsible for activity under your account. One person may register as an Owner, a Seller, or both, using the role the Site asks for at signup.

Registration requires you to accept the then-current Terms and Privacy Policy. We record the version of each, the time of acceptance, and, when available, the IP address and user agent of that request. If we publish a new version, you must accept it before continuing to use signed-in features.

We may refuse, suspend, or close an account that breaks these Terms or the law, or that we reasonably believe is unsafe or fraudulent.

3. Listings, goods, storage, and handling

Owners are responsible for the goods they list, including ownership, description, condition, legality, and the right to sell. Sellers are responsible for how they store, handle, transport, list, and sell those goods, and for any promise they make to an Owner or a Buyer.

Storage locations, handling, pickup, drop-off, and disposal are arranged between users. The operators do not provide storage, do not insure goods, and do not supervise chain of custody. Risk of loss, damage, theft, or an unsatisfactory sale sits with the users involved.

You must not list or sell illegal items, stolen goods, or items you have no right to sell.

4. Payments and disputes between users

The Site may calculate suggested fees, holds, owner payouts, seller compensation, and referral amounts, and it may record a payment status. The platform's application fee is ordinarily a share of seller compensation or seller commission. The first 50 sellers to sign up are Founding Sellers: that application fee is $0 on their jobs for 3 months from sign-up, and their profile shows a Founding Seller badge. When an Owner sets the price, the suggested daily storage charge is free for the first 7 days after possession or listing and accrues from day 8 while the goods remain unsold. Those figures are tools for users. When card payments are turned on, Stripe processes card charges, refunds, and payouts to connected accounts as our payment processor. We do not store full card numbers. An asking-price charge is collected in Canadian dollars on the platform balance and may later be transferred to an Owner (or a referral recipient) or refunded, following the job. The purchase price a Buyer pays a Seller for the goods remains a matter between those people.

Before an Owner books a Seller, the Owner saves a card. Nothing is charged for booking or when the Seller picks the goods up. Every booking guarantees the goods are taken away. In Stuff Specs the Owner can upload a photo. The Site may classify the goods as likely to sell, maybe, or likely junk, and it shows a removal quote. If that check is unavailable, the Owner picks an item type. The quote is labour, driving from the Owner's address to the nearest disposal facility, and the estimated dump cost, plus a platform cut of 15% on top with a $10 minimum. Quotes schedule the dump off-peak, so the off-peak dump minimum applies unless a peak run is requested. Fridges, freezers, washers, dryers, stoves, electronics, scrap metal, and bikes are taken to a free drop-off or donation and the dump charge is $0. The Owner may choose flexible timing, wait a few days, and take about 10% off the quote. That discount is absorbed by the platform cut, down to $0, and does not reduce what the Seller is paid. Stuff Specs also records floor, elevator, distance to the truck, and tight spots or disassembly, which change the time in the quote. Likely junk is booked as removal: there is no listing and no price drop, and the quote is charged to the saved card when the Seller marks the job done. Likely to sell, or maybe, follows the sale. If the price reaches free and nobody takes the goods, removal runs at that quote. The Seller may upgrade a junk job to a listing at pickup. The Owner then pays nothing unless it fails to sell. The Owner's price is the quote. A faster job is charged for the actual time, which is less. The platform absorbs overruns up to 50% over the estimate. If the Owner's access answers were wrong, the Seller can post a photo in the conversation and the Owner is charged the difference. The Owner can contest a junk flag or that access charge through the dispute process on the Site. The platform cut is not paid to the Seller as profit, whether or not the goods later sell. The Seller is paid for labour and driving, at least $25 per pickup. Above $25, removal pay does not exceed a typical sale of that item. The Seller is reimbursed for the real dump cost documented with a weigh-scale receipt and a photo. If no dump receipt is provided, the estimated dump cost is refunded and the Seller is not reimbursed for dumping. After pickup on a sale, the Seller posts a link to the live listing in the Owner–Seller conversation within 2 days, and the job records it. If the goods have not sold, the price drops on a schedule until it is free. The Owner is notified at each drop. The first 7 days of storage stay free. Once the price is free, storage stops. We do not store full card numbers.

Disputes about goods, condition, price, storage, loss, damage, theft, non-payment, or conduct are between the users involved. The Site may offer a messaging or dispute screen so users can exchange their positions. That feature does not make the operators a judge, arbitrator, insurer, or guarantor, and it does not create a duty to resolve the dispute or to pay anyone.

Referral codes, when offered, credit a share of the Site's application fee on qualifying activity as described in the product. Referral amounts are not a wage and may change or end when these Terms or the product rules change. A referral does not make the referred person our agent.

5. Your content

You keep ownership of text, photos, and other material you submit. You grant the operators a non-exclusive licence to host, display, and reproduce that material solely to operate the Site. You represent that you have the rights needed to grant that licence and that your material does not infringe anyone else's rights.

6. Acceptable use

You will not misuse the Site, interfere with it, attempt to access another person's account or data, scrape it in a way that degrades the service, or use it to break the law. You will not hold yourself out as the operator of Sell the Stuff.

7. The Site is provided as is

The Site is provided "as is" and "as available". To the fullest extent permitted by applicable law, Sell the Stuff and its directors, officers, employees, and agents, and the owners and operators of www.SelltheStuff.com disclaim all warranties, representations, and conditions, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, or error-free, that listings will sell, that users will perform, or that any calculation, message, or payment record is complete.

Some jurisdictions do not allow certain disclaimers. In those places, the disclaimers apply to the maximum extent permitted.

8. Limitation of liability

To the fullest extent permitted by applicable law, Sell the Stuff and its directors, officers, employees, and agents, and the owners and operators of www.SelltheStuff.com will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or opportunity, arising out of or related to the Site, these Terms, or the goods, whether or not we were advised of the possibility.

Without limiting that exclusion, Sell the Stuff and its directors, officers, employees, and agents, and the owners and operators of www.SelltheStuff.com are not liable for goods that are lost, damaged, stolen, or sold, or for the condition, legality, delivery, storage, or non-sale of goods, or for any user-to-user dealing or dispute. Those matters are solely between the users involved.

To the fullest extent permitted by applicable law, the aggregate liability of Sell the Stuff and its directors, officers, employees, and agents, and the owners and operators of www.SelltheStuff.com for all claims arising out of or related to the Site or these Terms is limited to the greater of (a) the fees you actually paid to the operators for use of the Site in the three months before the event giving rise to the claim and (b) one hundred Canadian dollars (CAD $100).

This cap and these exclusions apply to every theory of liability, including contract, tort (including negligence), statute, and any other theory. They do not limit liability that applicable law does not allow to be limited or excluded, including liability for death or personal injury caused by negligence where such a limit is prohibited, or for fraud.

9. Indemnity and release

You will indemnify, defend, and hold harmless Sell the Stuff and its directors, officers, employees, and agents, and the owners and operators of www.SelltheStuff.com from and against any and all claims, losses, damages, liabilities, and expenses (including reasonable legal fees and disbursements) arising out of or related to:

  • your use of the website;
  • your content or listings;
  • your goods, including storage, handling, sale, loss, damage, or theft of those goods;
  • your dealings with another user or a Buyer; or
  • your breach of these Terms or of applicable law.

We may participate in the defence with counsel of our own choosing, at your expense for reasonable legal fees where the claim is covered by this indemnity. You will not settle a covered claim in a way that imposes an obligation on us or admits fault on our behalf without our prior written consent.

To the fullest extent permitted by applicable law, you release Sell the Stuff and its directors, officers, employees, and agents, and the owners and operators of www.SelltheStuff.com from any and all claims, demands, damages, and liabilities, known or unknown, arising out of or related to the Site, these Terms, the goods, or your dealings with other users or Buyers, including claims that goods were lost, damaged, stolen, or sold.

10. Suspension and changes

We may change, suspend, or discontinue any part of the Site. We may update these Terms by posting a new version and, when the terms version changes, requiring you to accept it. Continued use after a required acceptance is agreement to the new version. If you do not agree, stop using the Site and close your account.

11. Governing law

These Terms, and any dispute arising out of or related to them or the Site, are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules.

12. Dispute resolution

Subject to any rights that applicable law says cannot be waived, disputes arising out of these Terms or the Site between you and Sell the Stuff shall be brought in the courts located in the Province of British Columbia, Canada, and you and Sell the Stuff attorn to those courts.

Disputes between users about goods, money, or conduct are not disputes with Sell the Stuff or the owners and operators of www.SelltheStuff.com. Users must resolve those disputes among themselves.

13. General

If a provision of these Terms is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Sell the Stuff about the Site and replace prior understandings about the Site. They do not create a partnership, joint venture, or agency between you and Sell the Stuff, or between users and Sell the Stuff. You may not assign these Terms without our consent. We may assign them in connection with a reorganisation or sale of the Site.
